Je nach Vereinbarung kann es sich dabei um einen konkret zugewiesenen Arbeitsplatz (nummerierter Schreibtisch) oder um einen flexiblen Arbeitsplatz (Hot Desk) handeln.<\/p>\n<p style=\"text-align: left;\">Im Mietpreis enthalten ist die Nutzung folgender Einrichtungen:<\/p>\n<ul style=\"text-align: left;\" type=\"disc\">\n<li style=\"list-style-type: none;\">\n<ul type=\"disc\">\n<li>WLAN (drahtloser Internetzugang)<\/li>\n<li>Drucker (einschlie\u00dflich fair use von Druckpapier)<\/li>\n<li>Kaffeebar (inklusive Kaffee, Tee, Snacks, Mikrowelle und K\u00fchlschrank)<\/li>\n<li>Besprechungsraum (Phone-Booth \/ Meetingroom)<\/li>\n<li>Au\u00dfenbereich (Terrasse)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: left;\">Es wird ausdr\u00fccklich darum gebeten, Telefonate m\u00f6glichst in der Phone-Booth oder im Au\u00dfenbereich (Terrasse) zu f\u00fchren, um andere Nutzer des Coworking-Space nicht zu st\u00f6ren.<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<hr align=\"center\" size=\"2\" width=\"100%\" \/><\/div>\n<div align=\"center\">\n<p style=\"text-align: left;\">\n<\/div>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8220;4.27.4&#8243; _module_preset=&#8220;default&#8220; global_colors_info=&#8220;{}&#8220;]<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<p><b style=\"color: #333333; font-size: 22px;\">Paragraph 3: Nutzungszeiten und Zugangsbedingungen<\/b><\/p>\n<\/div>\n<p style=\"text-align: left;\">Der Mieter hat mit dem Tages- und Wochenpass von 9 bis 18 Uhr und mit dem Monatspass rund um die Uhr (24\/7) Zugang zum Coworking-Space \u201eFreshSurf\u201c mittels eines T\u00fcr-Pincodes oder einer speziell bereitgestellten App. Die festen \u00d6ffnungszeiten, w\u00e4hrend derer ein Ansprechpartner vor Ort zur Verf\u00fcgung steht, sind von 11:00 bis 14:00 Uhr (Montag bis Freitag).<\/p>\n<p style=\"text-align: left;\">Samstags bleibt der Coworking Space von 11 bis 14 Uhr geschlossen, da hier gr\u00fcndliche Reinigungsarbeiten durchgef\u00fchrt werden.<\/p>\n<p style=\"text-align: left;\">Der Zugang f\u00fcr Dritte ist gestattet, jedoch unter der Voraussetzung, dass die gleichen Kosten wie f\u00fcr den Mieter anfallen. Der Mieter ist verpflichtet, den Vermieter im Voraus \u00fcber die Nutzung durch Dritte zu informieren.<\/p>\n<p style=\"text-align: left;\">Die vom Vermieter bereitgestellten Zugangscodes sind personenbezogen und d\u00fcrfen nicht an Dritte weitergegeben werden. Die Codes k\u00f6nnen vom Vermieter zeitlich begrenzt und bei Bedarf erneuert werden. Ein Missbrauch der Zugangsdaten f\u00fchrt zu einem sofortigen Entzug der Zugangsberechtigung.<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<hr align=\"center\" size=\"2\" width=\"100%\" \/><\/div>\n<div align=\"center\">\n<p style=\"text-align: left;\">\n<\/div>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8220;4.27.4&#8243; _module_preset=&#8220;default&#8220; global_colors_info=&#8220;{}&#8220;]<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<p><b style=\"color: #333333; font-size: 22px;\">Paragraph 4: Mietpreis und Zahlungsmodalit\u00e4ten<\/b><\/p>\n<\/div>\n<p style=\"text-align: left;\">Der Mietpreis f\u00fcr die Nutzung des Coworking-Space \u201eFreshSurf\u201c betr\u00e4gt:<\/p>\n<ul style=\"text-align: left;\" type=\"disc\">\n<li style=\"list-style-type: none;\">\n<ul type=\"disc\">\n<li><b>15 \u20ac pro Tag<\/b>,<\/li>\n<li><b>70 \u20ac pro Woche<\/b>, oder<\/li>\n<li><b>220 \u20ac pro Monat<\/b>,<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: left;\">je nach vereinbartem Nutzungszeitraum.<\/p>\n<p style=\"text-align: left;\">Die Zahlung erfolgt im Voraus und kann auf folgende Weise geleistet werden:<\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 14px;\">Per Bank\u00fcberweisung auf das vom Vermieter angegebene Konto,<\/span><\/p>\n<ul style=\"text-align: left;\" type=\"disc\">\n<li style=\"list-style-type: none;\">\n<ul type=\"disc\">\n<li>\u00dcber PayPal an die Adresse \u201eoffice@freshsurf.de\u201c,<\/li>\n<li>Per Kreditkarte oder in bar vor Ort.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: left;\">Zus\u00e4tzlich fallen f\u00fcr die Nutzung des Druckers Kosten von\u00a0<b>0,10 \u20ac pro Schwarz-Wei\u00df-Seite<\/b>\u00a0und\u00a0<b>0,25 \u20ac pro Farbseite<\/b>\u00a0an. Diese Kosten werden gesondert abgerechnet und sind ebenfalls im Voraus oder direkt nach der Nutzung zu begleichen.<\/p>\n<p style=\"text-align: left;\">Eine Kaution wird nicht erhoben.<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<hr align=\"center\" size=\"2\" width=\"100%\" \/><\/div>\n<div align=\"center\">\n<p style=\"text-align: left;\">\n<\/div>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8220;4.27.4&#8243; _module_preset=&#8220;default&#8220; global_colors_info=&#8220;{}&#8220;]<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<p><b style=\"color: #333333; font-size: 22px;\">Paragraph 5: Rechte und Pflichten der Vertragsparteien<\/p>\n<p><\/b><\/p>\n<\/div>\n<ol style=\"text-align: left;\" start=\"1\" type=\"1\">\n<li style=\"list-style-type: none;\">\n<ol start=\"1\" type=\"1\">\n<li><b>Verhaltensrichtlinien:<\/b><br \/>Die Nutzer des Coworking-Space \u201eFreshSurf\u201c verpflichten sich zu einem respektvollen und r\u00fccksichtsvollen Verhalten gegen\u00fcber anderen Mietern. Dies umfasst insbesondere:\n<ul type=\"circle\">\n<li>Einhaltung der allgemeinen Ordnung und Sauberkeit in allen R\u00e4umlichkeiten, einschlie\u00dflich gemeinschaftlich genutzter Bereiche wie der Kaffeebar, der Phone-Booth und der Terrasse.<\/li>\n<li>Vermeidung unn\u00f6tiger L\u00e4rmbel\u00e4stigungen. Gespr\u00e4che und Telefonate sollen, soweit m\u00f6glich, in den daf\u00fcr vorgesehenen Bereichen (Phone-Booth oder Terrasse) gef\u00fchrt werden.<\/li>\n<li>Angemessene Nutzung der bereitgestellten Einrichtungen und Ger\u00e4te.<\/li>\n<\/ul>\n<\/li>\n<li><b>Haftung:<\/b><br \/>Der Mieter ist verpflichtet, Sch\u00e4den, die durch unsachgem\u00e4\u00dfe Nutzung der R\u00e4umlichkeiten, Einrichtungen oder bereitgestellten Gegenst\u00e4nde entstehen, in vollem Umfang zu ersetzen.<\/li>\n<li><b>Hausordnung:<\/b>\n<ul type=\"circle\">\n<li>Rauchen ist in s\u00e4mtlichen Innenr\u00e4umen des Coworking-Spaces streng untersagt.<\/li>\n<li>Haustiere d\u00fcrfen nicht mitgebracht werden.<\/li>\n<li>Der Verzehr von stark riechenden Speisen im Innenbereich ist zu vermeiden. Solche Speisen sollten im Au\u00dfenbereich (Terrasse) konsumiert werden.<\/li>\n<li>Die Nutzung der R\u00e4umlichkeiten ist ausschlie\u00dflich f\u00fcr legale und berufliche T\u00e4tigkeiten gestattet. Jegliche T\u00e4tigkeiten, die dem Ansehen oder den Interessen des Vermieters schaden k\u00f6nnten, sind untersagt.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<div style=\"text-align: left;\" align=\"center\">\n<hr align=\"center\" size=\"2\" width=\"100%\" \/><\/div>\n<div align=\"center\">\n<p style=\"text-align: left;\">\n<\/div>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8220;4.27.4&#8243; _module_preset=&#8220;default&#8220; custom_padding=&#8220;0px|||||&#8220; global_colors_info=&#8220;{}&#8220;]<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<h3><b style=\"color: #333333; font-size: 22px;\">Paragraph 6: Nutzung des WLANs<\/b><\/h3>\n<p>&nbsp;<\/p>\n<\/div>\n<p style=\"text-align: left;\"><b style=\"font-size: 14px;\">1. Bereitstellung und Zweck:<br \/><\/b><span style=\"font-size: 14px;\">Der Vermieter stellt dem Mieter im Rahmen der vereinbarten Leistungen Zugang zum WLAN-Netzwerk des Coworking-Spaces zur Verf\u00fcgung. Der Zugang dient ausschlie\u00dflich der beruflichen und legalen Nutzung.<\/span><\/p>\n<p><b>2. Verbotene Nutzungen:<\/b><br \/>Es ist ausdr\u00fccklich untersagt, das WLAN-Netzwerk f\u00fcr folgende Zwecke zu verwenden:<\/p>\n<ul type=\"circle\">\n<li>Zugriff auf Seiten oder Inhalte, die pornografisch, gewaltverherrlichend, diskriminierend oder in anderer Weise gegen geltendes Recht oder die guten Sitten versto\u00dfen.<\/li>\n<li>Nutzung von Gl\u00fccksspielseiten, Gaming-Plattformen oder anderen Diensten, die nicht dem beruflichen Zweck dienen.<\/li>\n<li>Das Herunterladen oder Verbreiten urheberrechtlich gesch\u00fctzter Inhalte ohne entsprechende Berechtigung.<\/li>\n<li>Versand von Spam, Massen-E-Mails oder anderen unerw\u00fcnschten Werbeinhalten.<\/li>\n<li>Durchf\u00fchrung von Hacking, Phishing oder sonstigen Aktivit\u00e4ten, die gegen geltendes Recht oder die Sicherheit des Netzwerks versto\u00dfen.<\/li>\n<li>T\u00e4tigkeiten, die den Betrieb des Netzwerks st\u00f6ren oder gef\u00e4hrden k\u00f6nnen, wie z. B. das Versenden von Schadsoftware oder das Hochladen gro\u00dfer Datenmengen ohne Genehmigung.<\/li>\n<\/ul>\n<p><b>3. Haftung, \u00dcberwachung und Sanktionen:<\/b><br \/>Der Mieter ist f\u00fcr die Nutzung des WLANs in vollem Umfang selbst verantwortlich. Jegliche Verst\u00f6\u00dfe gegen diese Regelungen f\u00fchren zu einer sofortigen Sperrung des Zugangs und k\u00f6nnen rechtliche Konsequenzen nach sich ziehen.<\/p>\n<p style=\"text-align: left;\">Der Vermieter beh\u00e4lt sich das Recht vor, bei Verdacht auf missbr\u00e4uchliche Nutzung Ma\u00dfnahmen zu ergreifen, einschlie\u00dflich der Sperrung des Internetzugangs f\u00fcr den Mieter. Der Vermieter gew\u00e4hrleistet jedoch keine aktive \u00dcberwachung des individuellen Datenverkehrs, um die Privatsph\u00e4re der Mieter zu sch\u00fctzen.<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<hr align=\"center\" size=\"2\" width=\"100%\" \/>\n<p>&nbsp;<\/p>\n<\/div>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8220;4.27.4&#8243; _module_preset=&#8220;default&#8220; header_3_text_color=&#8220;#000000&#8243; custom_padding=&#8220;0px|||||&#8220; global_colors_info=&#8220;{}&#8220;]<\/p>\n<h3><b>Paragraph 7: Vertragsdauer und K\u00fcndigung<\/b><\/h3>\n<ol style=\"text-align: left;\" start=\"1\" type=\"1\">\n<li style=\"list-style-type: none;\">\n<ol start=\"1\" type=\"1\">\n<li><b>Vertragsdauer:<\/b><br \/>Die Vertragsdauer ist flexibel und wird individuell mit dem Mieter vereinbart. Sie kann von einem Tag bis zu zw\u00f6lf Monaten betragen. Sofern keine gegenteilige Vereinbarung getroffen wird, endet der Vertrag automatisch mit Ablauf der vereinbarten Dauer.<\/li>\n<li><b>Vertragsverl\u00e4ngerung:<\/b><br \/>Eine Verl\u00e4ngerung des Vertrags ist durch m\u00fcndliche oder schriftliche Information an den Vermieter vor Ablauf der bestehenden Vertragsdauer m\u00f6glich. Der verl\u00e4ngerte Vertrag unterliegt denselben Bedingungen wie der urspr\u00fcngliche Vertrag, sofern nichts anderes vereinbart wurde.<\/li>\n<li><b>K\u00fcndigungsfrist:<\/b><br \/>Bei Vertr\u00e4gen mit einer monatlichen Laufzeit kann der Vertrag mit einer Frist von 14 Tagen zum Monatsende gek\u00fcndigt werden. F\u00fcr Vertr\u00e4ge mit k\u00fcrzerer Laufzeit ist eine K\u00fcndigung nicht erforderlich, da diese mit Ablauf der vereinbarten Dauer automatisch enden.<\/li>\n<li><b>Sonderk\u00fcndigungsrecht:<\/b><br \/>Ein Sonderk\u00fcndigungsrecht wird nicht einger\u00e4umt.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<div style=\"text-align: left;\" align=\"center\">\n<hr align=\"center\" size=\"2\" width=\"100%\" \/>\n<\/div>\n<div align=\"center\">\n<p style=\"text-align: left;\">\n<\/div>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8220;4.27.4&#8243; _module_preset=&#8220;default&#8220; global_colors_info=&#8220;{}&#8220;]<\/p>\n<div style=\"text-align: left;\" align=\"center\">\n<p><b style=\"color: #333333; font-size: 22px;\">Paragraph 8: Datenschutz und Vertraulichkeit<\/p>\n<p><\/b><\/p>\n<\/div>\n<ol style=\"text-align: left;\" start=\"1\" type=\"1\">\n<li style=\"list-style-type: none;\">\n<ol start=\"1\" type=\"1\">\n<li><b>Datenschutz:<\/b><br \/>Der Vermieter verpflichtet sich, alle personenbezogenen Daten des Mieters gem\u00e4\u00df den Vorgaben der europ\u00e4ischen Datenschutz-Grundverordnung (DSGVO) und des spanischen Datenschutzgesetzes (Ley Org\u00e1nica de Protecci\u00f3n de Datos Personales y garant\u00eda de los derechos digitales, LOPD-GDD) zu verarbeiten.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"text-align: left;\">Die Erhebung und Speicherung der Daten erfolgt ausschlie\u00dflich im Rahmen der Vertragsabwicklung. Hierzu geh\u00f6ren Name, Kontaktinformationen, Zahlungsdaten und andere f\u00fcr den Vertrag relevante Informationen. Eine Weitergabe der Daten an Dritte erfolgt nicht, es sei denn, dies ist zur Erf\u00fcllung gesetzlicher Vorschriften erforderlich.<\/p>\n<p style=\"text-align: left;\">Der Mieter kann freiwillig zustimmen, dass seine Kontaktdaten (z. B. E-Mail-Adresse) zu Marketingzwecken verwendet werden, wie z. B. f\u00fcr den Erhalt von Newslettern oder Informationen \u00fcber aktuelle Angebote von FreshSurf. Diese Zustimmung kann jederzeit widerrufen werden.<\/p>\n<ol style=\"text-align: left;\" start=\"2\" type=\"1\">\n<li style=\"list-style-type: none;\">\n<ol start=\"2\" type=\"1\">\n<li><b>Vertraulichkeit:<\/b><br \/>Beide Parteien verpflichten sich, alle im Rahmen dieses Vertrags ausgetauschten Informationen, die als vertraulich gekennzeichnet sind oder deren vertraulicher Charakter offensichtlich ist, vertraulich zu behandeln. Eine Weitergabe an Dritte ist nur mit vorheriger schriftlicher Zustimmung der anderen Partei zul\u00e4ssig.<\/li>\n<li><b>Ausnahmen:<\/b><br \/>Die Verpflichtung zur Vertraulichkeit entf\u00e4llt, wenn die Offenlegung der Informationen aufgrund gesetzlicher Vorschriften, beh\u00f6rdlicher Anfragen oder gerichtlicher Entscheidungen erforderlich ist.
